Protection Program For Everyday Inventors

New Preliminary US Patent Protection Program For Everyday Inventors

This new service is provided by the United States Patent and Trademark Office (USPTO), called, 'Document Disclosure', and is being used by patent attorneys and product inventors alike. This new procedure precedes the patent application and preserves, for two years, from date of conception for the invention. The program provides evidence of proof with the patent office.

The program was primarily developed due to the lack of staff and time to process the number of patent applications be presented. This also replaces the old method of protection where inventors would simply document their idea and mail it to themselves.

While this program is not a patent application, nor will the receipt date of the Document Disclosure become the effective filing date of a later filed patent application it gives the filing entity, date of conception, protection.

Your Disclosure Document is retained for two years after the patent office receives and receipts the inventor with a document number. After two years, unless it is referred to in a related patent application filed, the Disclosure Document is destroyed.

The two-year retention period is not be considered to be a 'grace period' during which the inventor can wait to file his or her patent application without possible loss of benefits. It must be recognized that in establishing priority of invention an affidavit or testimony referring to a Disclosure Document must usually also establish diligence in completing the invention or in filing the patent application since the filing of the Disclosure Document.

Cost for this Disclosure Document program is a one-time only $10.00 fee. Anyone can contact the USPTO and create necessary drawing and documents, which includes a cover letter, disclosure description, information page and return receipt letter.
